Can I Claim Deduction u/s 80DD for Expense on Sister Despite My Father Being Alive ?

My father is a pensioner and his pension is less than my salary. My sister is a disabled dependant with 90% disability. She is dependant on me. Can I get rebate under section 80DD ? My DDO says that your father is alive and is getting pension; so you cannot claim deduction. Is it true? Chiranjib Mitra , Siliguri

 

You DDO is not correct. The deduction u/s 80DD is for dependent of an individual tax payer. The meaning of dependant is given in explanation below section 80DD which is as under.

 

Explanation.For the purposes of this section,

(a) ………….

(b) dependant means

(i) in the case of an individual, the spouse, children, parents, brothers and sisters of the individual or any of them;

(ii)……

You should just give an undertaking from your father that your sister is dependant you and not on father. If DDO is not agreeing , he is misinterpreting .

 

Even if he does not agree, you must claim deduction in Return of Income filed by you. In fact this is common problem associated with DDO’s  wrong interpretation. I have answered earlier also same question here What Is the Meaning of Dependant for Claim of deduction u/s 80DD?
