Why do You Arrest, If you Can Not Charge sheet !

CBI arrestsMedia wieldy reported that Special CBI Judge Swarana Kanta Sharma gave bail to IT Director (Investigations) Kunal Singh, Director of Income Tax (Investigation) and four others as the CBI fails to file charge sheet for want of  sanction order to prosecute public servants in time.

It was reported earlier that Kunbal Singh was a  senior income tax officer, arrested for accepting Rs 30 lakh as bribe from a realtor –Eldeco  -in a tax evasion case, was today granted bail by a Delhi court due to the CBI’s failure in filing the charge sheet within 60 days.

The four others , arrested in connection with same office , were  given bail in the case are: Managing Director of realty firm Eldeco Pankaj Bajaj, Income Tax department’s Additional Director Investigation Ratan Singh, Assistant Director Uma Kant, Inspector Harish Dhaundiyal and Chartered Accountant Anil Jaiswal.

Readers may note that aforesaid officials were arrested by the CBI on June 4 in the graft case reletaed to reality firm Eldeco . The court gave bail to all the five accused on a personal bond of Rs one lakh along with two sureties of like amount.

The court granted bail to the accused as the CBI failed to file its charge sheet in the case in statutorily stipulated 60-day period since their arrest.

“While dealing with order granting bail in this case, my conscience forces me to observe a few things which I have come across dealing with CBI cases in the past few months. “In the present case as in several other cases, challan could not be filed since sanction for prosecution of accused could not be obtained by CBI in time and without an order of grant of sanction for prosecution, the court cannot take cognisance of the offences against the public servants who are caught by the CBI or any other prosecuting agency indulging in corruption whether by way of accepting bribe or found in possession of assets disproportionate to their known source of income,” the judge said.
